Task Force makes scrip fraud arrests

The US 119 Drug and Violent Crime Task Force made more arrests recently involving powerful prescription only narcotics.

• Matthew Erin Methvin, 30, of Chapmanville, was arrested in Logan County by members of the US 119 Drug and Violent Crime Task Force for four counts of obtaining a controlled substance by fraud on Oct. 16.

• Kourtney Denise Methvin, 32, of Chapmanville, was arrested in Logan County by the US 119 Task Force for five counts of obtaining a controlled substance by fraud on Oct. 16.

According to police reports the officers received a complaint from a pharmacist at an area pharmacy stating "the above defendant passed four prescriptions from Aphacare Medical Center...Ga....written to the accused for 45 Percocet 7.5 mg tablets containing Oxycodone, a schedule II controlled substance with the signature of Miriam Latif."

"The accused passed the prescription on 8/23/09 then passed three prescriptions for 60 percocet 10 mg tablets on 9/12 2009, two on 9/22/09 and 10/01/09 for percocet 10 mg tablets, all with the signature of Miriam Latif," the report states noting the pharmacist contacted Dr. Latif abut the prescriptions and that Dr. Latif stated she hadn't signed any prescription and they were not hers. On Oct. 13, 2009, the undersigned officer contacted Dr. Latif's office and faxed copies of the prescriptions to the office to have the doctor review the prescriptions. The undersigned received a fax letter back stating that none of the prescriptions were true, it was not her signature and she did not prescribe medications for the accused. The pharmacist...positively identified the accused as the person who dropped the prescriptions off and picked the Percocets up."

A warrant was issued for their arrest and the Methvin's were released on bond, following arraignment.

• Shelby Hatfield Zirkle, 34 of Accoville, was arrested in Logan County by members of the US 119 Drug and Violent Crime Task Force for obtaining a controlled substance by fraud on Oct. 13.

According to police reports on Sept. 28, Zirkle allegedly entered a local pharmacy and dropped off a prescription for another individual for 60 OxyContin 40 mg tablets.

"It had been written on a prescription from Family Healthcare Associates from Man, WV and the signature of Dr. Muscari had been forged," the report states. "The defendant picked the prescription up on the same date at approximately 8:49 p.m. and the defendant paid cash, $363.99. One of the store employees identified Shelby Hatfield Zirkle as the person dropping off the prescription and picked up the Oxycodone. This occurred in the city limits of Chapmanville." A second criminal complaint states Zirkle allegedly dropped of a different prescription with another name on it on Sept. 24, which had been forged and picked that prescription up at 7:36 p.m. and paid $539.19 in cash.

A warrant was issued for her arrest and she was taken into custody and booked at the Southwestern Regional Jail at Holden at 6:07 p.m.

• David Clarence Kirk, 22, of Amherstdale, was arrested in Logan County by the US 119 Task Force for obtaining a controlled substance by fraud on Oct. 7.

According to police reports the Task Force received a tip from a local pharmacist "in regards to a forged prescription and the individual was waiting on the prescriptions to be filled," and the officers rushed to the store.

"The pharmacist identified the above subject as t he person who gave the prescription to be filled," the report states. "The prescription was filled and the above subject paid $539.19 and took possession of the controlled substance, 90 OxyContin 40 mg tablets, a schedule II controlled substance. Subject was arrested upon taking possession of the controlled substance."

He was booked at the regional jail at 9:45 p.m.

• Debra Ann Marich, 50, of Kistler, was arrested in Logan County by Sgt. W.D. Walls of the Man Police Department on Oct. 22 for DUI on a controlled substance and driving left of center. According to the police report Sgt. Walls received a BOLO (Be On Look Out) alert in regards to a possibly impaired driver in a Ford Explorer.

"A traffic stop was initiated at the Speedway on Main Street." The report states, adding that Marich was "unsteady on her feet" and said she was not under the influence of alcohol or drugs, when she failed the standard field sobriety tests.

"The ALCO-Sensor was administered for Blood Alcohol Content and read .000," the report states, adding that when Marish was asked again if she had taken any medication she said she had not. "She stated that she had taken medicine for migraines. The accused was placed under arrest for DUI -controlled substances. At this time, the accused stated she 'had taken a few xanaxes two hours ago.' After transporting the accused to town hall for processing, she kept asking if there 'was anything she could do to make this go away.'" She was transported to Logan Regional Medical Center for a blood test.

She was booked at the regional jail at 1:40 a.m.

•Jermain Copa Clemons, 34, of Logan was arrested in Logan County, agency not listed on Oct. 14. Clemons reportedly failed to appear in court for his earlier charges of delivery of a controlled substance and conspiracy to deliver a controlled substance.

He was booked at the regional jail at 2:45 p.m. Clemons was originally arrested by the West Virginia State Police for delivery of a controlled substance and conspiracy on June 26. According to reports on June 24, "the defendant did deliver crack-cocaine to a cooperating individual working with officers..."During this investigation the pre-photocopied and rewarded money was recovered from the defendant which was used in the transaction described above."
