Notice is hereby given that Apogee Coal Company, LLC, HC61 Box 156, Yolyn, WV 25654 has submitted an application to the Department of Environmental Protection, 1101 George Kostas Drive, Logan, WV 25601 for a Significant Permit Revision to Article 3 Permit Number S015974 to change the post mining land use from hayland/pastureland to hayland/pastureland and forestland. The revised permit will discharge into Dingess Branch, Cartwright Branch, and Right Fork of Buffalo Creek of Guyandotte River and is located 1.8 miles, South of Lorado in Buffalo/Oceana District of Logan/Wyoming County. Longitude 81° 42' 30" and Latitude 37° 46' 15".

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP office and address above until December 13, 2009, or thirty (30) days from date of final publication. A copy of the application will be available for review until December 13, 2009, or thirty (30) days from date of final publication in the DEP Regional Office located at the address above AND in the Logan/Wyoming County Clerk's Office during normal business hours.
