CHARLESTON – A Boone County man has been sentenced to federal prison for possession with intent to distribute oxycodone.

U.S. Attorney Booth Goodwin today announced that a Boone County man

Gary Profitt, 55, of Danville, was sentenced to a year and a half in federal prison by United States District Judge John T. Copenhaver Jr.

Profitt had previously pleaded guilty in March.

On March 27, 2009, law enforcement officers conducted a traffic stop of the defendant’s vehicle near Danville. At the time of the traffic stop, the defendant was found to be in possession of 28 oxycodone pills. After the defendant was advised of his Miranda rights, he admitted possession of the pills and that he intended to distribute the pills in and around Boone County. Profitt further admitted that he made other trips to obtain oxycodone pills during a six-month period prior to his arrest on March 27, 2009.

This case was prosecuted as part of an ongoing effort led by the United States Attorney’s Office for the Southern District of West Virginia to combat the illicit sale and misuse of prescription drugs.

The Drug Enforcement Administration (DEA) conducted the investigation. Assistant United States Attorney John Frail handled the prosecution.
