Joyriding, among other charges, left a Logan couple incarcerated recently.

Joshua Nida, 29, of Logan, was also charged with DUI 1st offense, no seat belt, no proof of insurance and obstructing. Nicole Nida, 29, of Logan, was also charged with obstructing, public intoxication and no seat belt.

According to a criminal complaint, W.Va. State Trooper J.G. Honaker was observing traffic in West Logan when he observed a “Red 2008 Chevy Trail Blazer sitting in the roadway.” Honaker conducted a traffic stop on the vehicle and found the driver of the vehicle to be “the defendant Joshua Nida, who was not wearing a seat belt.”

Honaker approached the vehicle and allegedly observed “the defendants (Joshua Nida) speech was slurred” and when asked to exit the vehicle by Honaker, Mr. Nida allegedly “tripped getting out of the vehicle.” Honaker conducted a field sobriety test which Mr. Nida failed due to “the defendant stepped off the line several times and did not touch heel to toe… could not keep his hands down to his side… and had a horizontal gaze nystagmus in both eyes.”

Mr. Nida allegedly advised Honaker that he had taken several “types of pills and some coke cane (sic) a day before.” He also allegedly advised that he had taken “suboxone, xanax and kalonapen that same morning.”

Honaker states in the complaint that a BOLO (Be On Look Out) was issued earlier that morning on the same vehicle that “was driving recklessly and almost hit a person on the sidewalk.” He had located the vehicle in the city of Logan and transported the “defendant to his house and was advised that if the undersigned officer saw him out driving again that day he was going to jail.”

Honaker was unable to locate any insurance on the vehicle and was advised by the vehicle owner “that the driver did not have permission to have that vehicle.”

While conducting his investigation on Joshua Nida, Honaker allegedly observed Nicole Nida, a passenger in the vehicle, “did not have a seat belt” and had “slurred speech and admitted to the undersigned officer that she had taken several suboxone and xanax.”

Nicole Nida was arraigned in magistrate’s court on June 16 where bail was set at $5,000.

Arraignment was attempted for Joshua Nida on June 16, but an accused has to be mentally competent and alert to arraign, the hearing status was put on “pending” due to Nida being “intoxicated at the time.” He again was brought to magistrate’s court on June 18 and the hearing status was placed again on “pending.” On June 19, Nida appeared again in magistrate’s court and was placed on a $5,000 bail. Additional condition of the bail was that Nida must attend an interview for the Future’s Program.
