Lawsuit accuses Logan deputies of rape

CHARLESTON (AP) — A federal lawsuit alleges three Logan County sheriff’s deputies sexually assaulted a woman after accosting her and her companions outside a Logan bar.

The U.S. District Court case does not identify the deputies or the woman and two men who filed it alleging the September 2008 incident.

The lawsuit says the deputies put the woman in a patrol car after she failed field sobriety tests. It also alleges the deputies threatened to kill the woman’s two companions.

The woman was allegedly driven to a dirt road and raped by three deputies while a fourth stayed in the vehicle. The lawsuit says the woman went to a hospital after they released her.

Defendants also include Logan County’s sheriff and commission, and an unidentified Chapmanville police officer who allegedly helped accost the plaintiffs.

Logan County Sheriff Eddie Hunter was not available for comment this morning and has directed all calls to the prosecutor’s office in The Logan Banner’s previous attempts to get comments and information.

Logan County Prosecutor John Bennett said the investigation is ongoing.

“I have some information on it, yes,” Bennett said. “It’s being investigated by a variety of individuals and so far I’ve not received all the work. I’ve received part of it from one outfit and not another. It’s my understanding they’re still working on it.”

Bennett declined to say what law enforcement organizations are investigating the allegations.

“It’s outside the sheriff’s office,” Bennett said. “The sheriff is not investigating it. It’s seperate agencies.”

Bennett said he learned of the lawsuit two days ago when another newspaper called wanting comments on the lawsuit.

“So far, the matter hasn’t been closed,” Bennett said. “The investigation is not finished. There are others who may be doing some additional work and I’ve discussed that with them and they are supposedly going to give that to me when they finish that work. I’ve not received it yet.”

Bennett said the deputies are still on the job.

“They are still working,” Bennett said. “There’s no charges pending yet.”

Bennett said he couldn’t comment further due to the ongoing status of the investigation.
