CHARLESTON (AP) — A Mingo County judge has issued contempt charges against three Southwestern Regional Jail correctional officers over the late delivery of inmates to his courtroom.

The Charleston Gazette reports that the state Regional Jail and Correctional Facility Authority is asking the West Virginia Supreme Court to overturn the charges.

According to the authority’s petition, Circuit Judge Michael Thornsbury ordered the officers’ arrest Thursday morning. They later were released and ordered to each pay a $50 fine.

Thornsbury says in his response to the petition that the jail has a history of not delivering inmates for circuit court proceedings in a timely manner. The judge says the officers violated his order requiring that all inmates be at the courthouse no later than 8:30 a.m.

The Supreme Court hasn’t acted on the petition.
