Fifty-one-year-old Greg Stowers was sentenced to six months in federal prison in 2006 after he and other defendants admitted buying votes in elections dating back more than a decade.
After the criminal proceedings, Stowers' opponent in the 1996 circuit clerk's race, Terry Hill, filed a lawsuit alleging Stowers stole the election.
Lincoln County Circuit Judge Jay Hoke dismissed the lawsuit, saying it wasn't a claim upon which relief could be granted. In his appeal, Hill says Hoke was too close to Stowers and should have recused himself from the case. A Supreme Court spokeswoman says motions to reinstate the case will be on the fall docket.
