Local man sentenced on drug charges

A local man with an extensive arrest record was sentenced to one to five years in prison on Aug. 12. The defendant was arrested for having three pounds of marijuana when he was on home confinement.

* Charles Lee White, 32, of Logan, went before Judge Roger Perry for sentencing on five counts of delivery of a controlled substance and possession with intent to deliver and home confinement violation charges. White reportedly was caught by the US 119 Drug Task Force selling drugs while on home confinement. He was reportedly caught with three pounds of marijuana. White had entered a guilty plea on the charges.

Judge Perry said White had a significant arrest record and that he suspected White had a drug abuse problem as well as sold drugs.

"At this point, I think a proper sentence would be one to five years," Perry said.

White was arrested by the WVSP for possession with intent to deliver and delivery of a controlled substance (five counts) on March 31, 2008. According to police reports Tpr. J.R. Brewer assisted by the Logan County Home Confinement office conducted a drug investigation on White on March 30.

"This officer discovered approximately three pounds of marijuana and large amounts of pain pills," the report states. "This officer was advised he does sell controlled substances to several people. The accused did sell lortabs to Leroy Chafin Jr. who was in the residence when this officer arrived. Mr. Chafin had a large amount of lortabs in his possession and advised he had just purchased them from the accused. The accused advised he had sold marijuana to a juvenile on at least four occasions, and this officer spoke with the juvenile who confirmed the four transactions."

White was arrested in September of 2007 for DUI, speeding, driving on a revoked license and possession by Tpr. C.E. Stump after a traffic stop.

White "had an odor of an alcoholic beverage coming from his mouth, and had a vegetation that appeared to be marijuana on his lap."

"The defendant's eyes were bloodshot and he was unsteady as he exited the vehicle," the report stated. "The defendant had a small bag of pot in his watch pocket and another bag was found in the center console of the vehicle, which had a broke diver's side door taillight."

* Henry Stewart reportedly was sentenced to 1-10 years in prison for arson charges and one year in jail following that on a Destruction of Property charge.

In other Logan County Courthouse news, sex abuse charges filed against a local man were dismissed recently after the victim recanted her testimony.

* Johnny Lee Cooper, 22, of Logan, was arrested by Chief E.K. Harper and Patrolman J.D. Adkins of the Logan Police Department for first degree sexual assault on Aug. 6. According to law enforcement reports the victim and defendant were at an apartment on Stratton Street when the supposed incident occurred on July 17. Originally the woman told police that Cooper "grabbed her by the neck and choked her and then struck her in the forehead," then forced her to perform a sex act with him. A warrant was issued for Cooper's arrest and he was taken into custody on Aug. 6 and was booked at the Southwestern Regional Jail at 10:33 p.m.

Later, the woman told the Logan County Prosecutor's Office that she recanted her testimony and claimed to have been on xanax at the time she made the allegation.

A spokesperson for the prosecutor's office noted that the case can be refiled if further evidence comes to light and noted that it is not uncommon in many domestic incidents for the victims to drop charges against a spouse or boyfriend after an arrest has been made.

It wasn't the only case dismissed recently. False swearing charges against former defense attorney Joe Spradling were also dismissed. According to court documents in the case "the state did not follow through with civil remedies" and the case was dismissed by Cabell County Magistrate Brenda Chapman. The case was originally filed in Logan Circuit Court.
