WAYNE — A Harts man is suing Stowers Trucking after he was injured while working as a coal truck driver.

Lincoln Leasing Company and Argus Energy Corporation were also named as defendants in the suit.

On July 27, 2010, Paul Israel was driving a coal truck that was excessively overloaded and was proceeding down the hill in Copley Trace while operating the vehicle in a safe manner when he went around a slight right hand curve in the roadway that caused the load on the coal truck to shift and the truck to turn over on the roadway, according to a complaint filed July 26 in Wayne Circuit Court.

Israel claims he suffered severe personal injuries as a result of the truck turning over on the roadway.

The coal truck was defective in that the spring hanger on the truck broke, causing the truck to roll over, according to the suit.

Israel claims the defendants failed to properly maintain and service the coal truck and failed to properly observe the weight restrictions for the safe and proper transportation of coal.
