WVa court upholds election fraud ruling

CHARLESTON (AP) — The state Supreme Court has refused to reinstate an election fraud case stemming from the 1996 write-in campaign for Lincoln County Circuit Clerk.

In its unsigned unanimous ruling, the high court upheld a 2007 Lincoln County Circuit Court decision that dismissed Terry Hill’s lawsuit.

Hill lost a write-in campaign to former Lincoln County Circuit Clerk Greg Stowers in 1996. Hill sued after Stowers pleaded guilty to vote fraud in 2005. The charge stemmed from Stowers’ 2004 re-election campaign.

Hill’s lawsuit said he was entitled to the salary and benefits he would have received if he had won.

The high court said it would have been impossible for Hill to show how voters would have voted a decade after the election.
