Turkale arraigned for murder

MAN — The grandmother of Aydin Toler is speaking out on the abuse that the 2-year-old endured during his short life and the man accused of Aydin’s murder was arraigned today in Magistrate’s Court.

Nicolas Turkale, 25, of Amherstdale, was charged with Murder and Murder of Child by Custodian before Magistrate Leondard Codispotti.

According to the criminal complaint, Turkale “did physically shove the victim, a two year old juvenile, into a door frame causing a skull fracture that ultimately resulted in the child’s death.” The complaint says that Turkale has provided care for the victim for approximately two years.

Since Turkale has been accused of a felony offense for which the penalty is life in prison, on the Circuit Court can grant and set bail. He is being held in the Southwestern Regional Jail until his appearance in Circuit Court.

In an interview with The Logan Banner, Aydin’s grandmother, Wanda Walls, says that the child been the victim of child abuse many times, and that several reports to the Child Protective Services were not investigated.

“Last year he came for a visit and he had black and blue hand prints on his face,” said Walls. “I took him to the hospital and they said that the only way that could be done was if someone just picked him up and swung him.”

Walls said that Aydin’s mother, Robin Toler, gave conflicting reports on how the injury occurred.

“She gave five or six different excuses and none of them fit,” said Walls. “They didn’t even call the state police, the hospital called Child Protective Services (CPS).”

CPS gave Walls temporary custody of Ayden until a hearing on the charges against Toler.

“The judge gave her a three-month improvement period with supervised visits,” said Walls. “At the end of the three month improvement period, she got full custody of him.”

Walls said that before that incident, Toler shared joint custody of Aydin with his father, Jeremy Walls.

Walls said that she was told conflicting reports on how Aydin was injured Tuesday.

“We were told at first that he fell off the kitchen counter. Then we were told that he was in the bathroom peeing and fell off the sink,” said Walls. “Then she said he was brushing his teeth and fell. But at his (Turkale) arraignment today, he admitted to slamming him into the door facing.”

Walls said she has several pictures of Aydin with bruises that were taken during visits to his father and that the CPS was notified each time.

“We have reported and reported and reported,” said Walls. “They (CPS) just ignored it. I told them last year on the courthouse steps after they gave her full custody of him that they just signed his death warrant. She may have not physically killed him, but she is just as guilty because she let it happen.

“That was the sweetest little baby. I don’t care what kind of mood somebody would be in — upset or mad — that little smile and the love in his eyes… I don’t see how anybody could do something like that to a child. No baby deserves that.”

Aydin would have celebrated his third birthday in November.

We need to be able to hold our state agencies accountable. When the social workers fail to do their job then the judical system fails to do its job as well. When you go into a court of law with complaints of child abuse/endangerment you have to have legal proof. When you can't trust those that your tax dollars are paying to do their job to make sure that those that they supposed to protect are being protected then they need to look for another position! We need them to take their position seriosly, we need them to go into court with the proof needed to get the courts to listen and get these children away from people who are harming them before they get the chance to murder them! If half the children abused were taken from their abusers when they were first reported to the state agency then we'd have at least half of those children alive today! And when those children are taken from these caregivers they need to be taken for a period of time that requires the caregiver to take some serious classes to make sure they are not a threat to that child! If they are a threat DO NOT return that child ever! Agency's know when a caregiver is not a responsible person and not a candidate for the return of a child-they just don't care!

Malana Chapman again......only difference is that Malana lived 12 years with her serious injuries then passed .....her bio father was in jail 4 years then walking the streets ofLogan again.....

Please don't blame the social workers.....the legal system really is their hands.....why did Malana's bio father get off so easy? The assistance prosecutor accepted a plea bargain...easy way for him to hanldle the case...I will always remember the prosecutor's statement, " she might walk again, many times children like her do better than the doctors say." ......Malana is sitting there functioning on her brain stem only and he made that statement.

Again, don't blame the CPS workers. They also get upset with the legal system.

The mother of the little boy needs to be jail too with the low life that did that to the little boy!!! She is no type of mother!!!!

So many people failed this child. The boy friend, definantly the mother, the judge and courts, CPS. What will happen now? The court will probably allow it to be pleaded down to the lesser of the crimes the boyfriend is charged with and he will be walking the streets in 2 years, or less. This was almost a complete copy of a childs death/murder that happened in Martin County Ky a couple years ago

I think CPS in Logan County is a joke and something should happen to the department for not taking the proper action.This child should have been removed and never allowed back at his mother's house. Because of their inability to properly do their job a child's life is lost. Both parents should be in jail not just one.

I think that CPS should be held liable as well. It is sad that they did not do there job to prorect this precious baby. To the loving family members ( those of you that really loved this child). I am so very sorry that you lost a presious angel so soon. To the mother I hope little Ayden's face haunts you for the rest of your life. You are a mother and as a mother you are supposed to protect your child. Even if it means your life.

Both parents need to go go jail for life. Child protective workers need to not only be fire but also go to prison for ignoring the grandmothers concerns.

I personally along with many others think this mother should have to serve time for allowing her 2 yr old child to be in a situation like this and not doing anything to prevent it and lying to the authorities to cover up what Nicholas Turkale done to this baby...not much of a mother instinct to lie about what happen to this precious little boy Knowing something happened even if she was asleep she heard the screaming and this took an awful hard blows to the head to cause sever brain trauma, kidneys trying to shut down and bleeding in the stomach...hard blows how could you not tell the truth while your baby is sitting there in a shape such as this...not understandable and he don't sound like the only guilty party he may have done the killing but she let him and then lied about it...some kind of mom that is!!

why hasent the police arrested the babys mom?she is just as guilty as he is so why put one away and leave the other one out.no matter what she says she was either helping him abuse the baby or she was an accesiory to it, she let it go on.why dident she stop him if she is so innocent.if someone is abuesing my child and i know it and cps wouldnt do anything i would take things into my own hands before i would let someone hurt them.

I live in a different state then this little angel that was taken so young. Sadly to say CPS even in Virginia have made mistakes by putting children back in the home after the child has been severely abused. My best friend is a child neurologist, he has had to declare several youngsters brain dead. In one case here she was a very pretty young girl about the age of this little angel, the parents told this doctor oh the child was peeing on the floor, she was getting up in the night eating, those were not excuses to kill the child. This little girl had been beaten at least 4 to 5 times before the step-mother killed the child. Both father and step mother were charge with her death. Had CPS done their job and protect these children that really need it and stop going after parents that don't abuse the child, more of our children's lives will be saved. Let's all start ratting when we see severe abuse before another child dies. Every 3 seconds a child dies somewhere of child abuse, a lot of children dying huh every 3 seconds. Speak up save a child. It might be your love one next. Love a child and give them a safe heaven.

CPS needs to be sued for allowing the death if this baby! Why did you give this angel back to an abusive home?? May god forgive you for allowing this child to be put thru hell and suffer at the hands of animals! I have heard over and over about CPS not following up and giving these babies back to the people that abuse them in rhe first pkace! What is wrong with you lazy ass people?? Once an abuser always an abuser!!! THEY dont change! God when will they get this!!!!

If he even gets prison time he will spend it in PC. Child abusers are a target even for mean guys.

Child molester and killers have a short life span in lockup.

This baby should have been protected from day one.

Again CPS has failed.But in a different county.They failded in Kanawha County for another child.[Logan Shane Goodall]I know a lot of people remembers that STORY.I will be praying for the little boy,and Grandmother.I been through this with my grandson. LOGAN SHANE GOODALL..Lock the boyfriend up for life,and the mother for what lies she has told.May this child r.i.p.Sue CPS It can be done..
