CHARLESTON, W.Va. (AP) — West Virginians could sue if the government tries to confiscate their guns or ammunition during declared states of emergency, through a measure advancing this legislative session.

A unanimous House of Delegates voted Friday to clarify a 2007 law meant to protect firearm ownership during such times. The bill heads to the Senate.

A number of states enacted such laws after New Orleans police confiscated guns while trying to restore order following Hurricane Katrina in 2005. The National Rifle Association has championed such measures. House Judiciary Chairman Tim Miley said the NRA endorsed Friday’s follow-up bill.

Miley’s committee advanced the bill last week, after amending it so the law applies both to federal- and state-declared emergencies.

House Speaker Rick Thompson sponsored the bill along with Miley and five other Democrats.

Another Dumb A$$ law by a bunch of Dumb A$$e$. Any U.S. citizen can sue any government (Federal, State, County or Local), if that government violates their Constitutional rights as per the 14th Amendment to the U.S. Constitution. This is just a feel good Law to kiss A$$ the NRA and the Chamber.

Well that didn't stop the military from doing it in New Orleans or people actually getting their guns back. They beat an old woman down over a revolver, broke her arm, blacked her eye. It's on Youtube, easily found. It's about time states stand up for their citizens unlike CA, CO, IL, and MD who are limiting them substantially from an ever encroaching Obama White House. NONE of the legislation proposed or even being talked about will stop one criminal from getting a gun. Criminals do not follow the law, it's why they're criminals. Peop;le need to wake up and start actually using common sense and legislators taking their oath and the Constitution seriously. The Constitution and Bill of Rights is not merely a set of suggestions to only follow when they feel like it. We're far enough off track as it is without law abiding gun owners having to suffer over what a psychotic who broke multiple laws to even commit the crime did.
